DMCA COPYRIGHT NOTICE & TAKEDOWN POLICY

Modern Gentleman Archive (“MGA”) respects the intellectual property rights of others and expects users, contributors, and third parties to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), MGA has adopted the following policy regarding copyright infringement.

NOTICE OF COPYRIGHT INFRINGEMENT

If you believe that material available on or through MGA infringes a copyright you own or control, you may submit a written DMCA takedown notice to our designated agent.

REQUIRED INFORMATION FOR DMCA NOTICE

To be effective, your notification must include the following information, as required under 17 U.S.C. §512(c)(3):

  1. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.

  2. Identification of the material that is claimed to be infringing, including the specific URL(s) or location(s) on the MGA website sufficient to permit us to locate the material.

  3. Your contact information, including:

    • Full legal name

    • Mailing address

    • Telephone number

    • Email address

  4. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

  6. Your physical or electronic signature.

Incomplete or non-compliant notices may not be processed.

RESPONSE TO VALID NOTICES

Upon receipt of a valid DMCA notice, MGA will:

  • Review the claim

  • Remove or disable access to the allegedly infringing material where appropriate

  • Take reasonable steps to notify the affected party, if applicable

MGA reserves the right to remove content at its sole discretion.

COUNTER-NOTIFICATION

If you believe that material you submitted or that was posted on MGA was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification.

A valid counter-notification must include:

  • Your name, address, and contact information

  • Identification of the material that was removed and its prior location

  • A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification

  • Consent to the jurisdiction of the federal court located in Florida

  • Your physical or electronic signature

Upon receipt of a valid counter-notification, MGA may restore the material unless the original complaining party files a court action within the time period required by law.

REPEAT INFRINGER POLICY

MGA maintains a policy of terminating, in appropriate circumstances, access to users or contributors who are determined to be repeat infringers.

GOOD-FAITH REQUIREMENT

Knowingly submitting false or misleading claims of infringement may result in liability under federal law. MGA reserves the right to seek damages for abusive or bad-faith DMCA notices.
